Dibsy Terms of Service
Effective date: 5 May 2026 Last updated: 5 May 2026 Operator: Omar Azam Ali Zaher, ABN 93 730 174 953, sole trader trading as “Dibsy”, based in Western Australia, Australia (“Dibsy”, “we”, “us”).
These Terms of Service (“Terms”) govern your use of the Dibsy mobile application (the “App”). By creating an account or using the App, you agree to these Terms. If you don’t agree, don’t use the App.
1. What Dibsy is
Dibsy is a free peer-to-peer giveaway platform for neighbours in Australia. Users post photos of unwanted household items, drop a map pin, and other users come to collect them in person. There is no money, no payments, no shipping. Items are exchanged at the lister’s location at the agreed time.
Dibsy is a connector, not a party to the exchange. We do not own, inspect, store, transport, or warrant any item listed on Dibsy. Every exchange is between the lister and the taker, at their own discretion and risk.
2. Eligibility
To use Dibsy you must:
- Be at least 18 years old.
- Be physically located in Australia.
- Have a working Australian mobile phone number.
- Not have been previously banned from Dibsy.
By signing in you confirm that you meet these requirements.
3. Your account
- You may only create one account per person.
- You must provide a phone number you control. We use it to verify you and to identify you to other users you transact with.
- You are responsible for activity on your account. Don’t share access or let others impersonate you.
- We may suspend or terminate accounts that are inactive, fraudulent, or in breach of these Terms.
4. What you can list
You may list household items you legally own and are entitled to give away. Each listing must include an honest description, at least one accurate photo, and a real pickup location.
Prohibited items (Tier 1 — hard block)
You may not list, and we will remove, the following:
- Asbestos and asbestos-containing materials.
- Hazardous chemicals including paint, solvents, pesticides, herbicides, motor oil, brake fluid, coolant.
- Loose batteries including car batteries, lithium-ion power tool batteries, e-scooter batteries.
- Tyres of any kind.
- Gas bottles and pressurised cylinders including LPG, oxygen, refrigerant.
- Firearms, ammunition, weapons, restricted knives, or any item regulated under the WA Firearms Act or Weapons Act.
- Mattresses with bodily fluids, visible damage, or pest infestation.
- Items containing refrigerant (fridges, freezers, air conditioners) unless certified as professionally degassed.
- Animals (live or dead), pets, livestock, wildlife.
- Counterfeit goods.
- Stolen goods or items you do not have the right to give away.
- Medications and medical waste including prescription drugs, OTC medications, sharps, used PPE.
- Items requiring registration transfer including vehicles, trailers, boats, caravans.
If you’re unsure where to dispose of any of the above, your local council, B-cycle (batteries), Soft Landing (mattresses), and the WA Department of Health (asbestos) all have appropriate channels.
Prohibited conduct
You may not, on or via Dibsy:
- Post anything illegal, hateful, harassing, threatening, sexually explicit, or that incites violence.
- Impersonate another person or misrepresent your identity.
- Solicit money, payment, donations, “thank you” gifts, or any other form of consideration in exchange for an item.
- List on behalf of a business, trade your inventory, or use Dibsy for commercial gain. Dibsy is for individuals giving away their own household items.
- Spam, scrape, or programmatically interact with the App.
- Attempt to circumvent moderation, suspensions, or bans.
- Use Dibsy chat for anything other than coordinating an exchange.
We may remove any listing or account that breaches these rules, with or without prior notice.
5. Reporting and moderation
If you see content that breaches these Terms, tap the Report button on the listing or chat. You can also block another user from your Profile.
Our response commitments:

We may, at our discretion, take any of the following actions: dismiss the report, warn the user, remove the listing, suspend the account temporarily, or ban the account permanently. For threats of violence, weapons, or stolen goods, we will escalate to WA Police where appropriate.
6. Your content
You retain ownership of the photos, descriptions, messages, and other content you post on Dibsy (“Your Content”).
By posting Your Content you grant Dibsy a worldwide, non-exclusive, royalty-free licence to host, store, display, and distribute Your Content within the App for the purpose of operating the service. This licence ends when you delete the content or your account, except where retention is required by law or to enforce these Terms.
You confirm that you have the right to post Your Content and that it does not infringe anyone else’s rights.
7. Items are provided “as is”
Items listed on Dibsy are given away by individuals, in person, with no warranty of any kind. To the extent permitted by law:
- We do not inspect, verify, or warrant the condition, safety, fitness, ownership, or legality of any item.
- We do not vet users beyond phone verification.
- We are not responsible for any item’s behaviour after pickup.
- The lister and the taker are responsible for the exchange and any consequences of it.
You should inspect any item before taking it home. If you have safety concerns about an item or a user, do not proceed with the pickup and report the listing.
Nothing in these Terms excludes any consumer rights you have under the Australian Consumer Law that cannot lawfully be excluded.
8. Limitation of liability
To the maximum extent permitted by law:
- Dibsy is provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation.
- We are not liable for any loss, damage, injury, or claim arising from any item listed, exchanged, or attempted to be exchanged on Dibsy.
- We are not liable for any conduct of any other user, on or off the App.
- Our total aggregate liability to you for any claim relating to the App is limited to AUD $100.
These limits apply whether the claim is in contract, tort, statute, or otherwise.
9. Indemnity
You agree to indemnify and hold Dibsy harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the App, the items you list or take, or your breach of these Terms.
10. Termination
You can delete your account at any time from Profile → Delete my account. Deletion is permanent and removes your profile, listings, dibs, messages, photos, push tokens, and reviews.
We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, broken the law, or put another user at risk. Where practical we will give you notice and a chance to respond, but we may act immediately for serious or repeat breaches.
Sections 7 (Items are provided “as is”), 8 (Limitation of liability), 9 (Indemnity), 12 (Governing law), and any provision that by its nature should survive, will survive termination.
11. Privacy
Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, available at https://dibsy.com.au/privacy.
12. Governing law
These Terms are governed by the laws of Western Australia, Australia. You and Dibsy submit to the exclusive jurisdiction of the courts of Western Australia for any dispute relating to these Terms or the App.
13. Changes to these Terms
We may update these Terms as the App evolves. When we do, we will:
- Update the “Last updated” date at the top of this page.
- Notify you in-app the next time you open Dibsy.
- For material changes, give you at least 14 days’ notice before they take effect.
Continued use of the App after a Terms change constitutes acceptance of the new Terms.
